This website summarizes the proposed Settlement Agreement reached in a lawsuit entitled Kaether v. Metropolitan Area EMS Authority, Cause No. 342-339562-23 in the District Court of Tarrant County, Texas, 32nd Judicial District (the “Litigation”).

A settlement has been reached in a class action lawsuit against Metropolitan Area EMS Authority d/b/a MedStar Mobile Healthcare (“MedStar”) arising out of a cyberattack on MedStar’s network in October 2022. On January 13, 2023, Plaintiff filed the class action lawsuit against MedStar based on a cyberattack on MedStar’s network in October 2022 (the “Incident”), alleging claims of negligence, breach of implied contract, negligence per se, breach of fiduciary duty, public disclosure of private facts, and unjust enrichment (the “Litigation”). On December 19, 2022, after a preliminary investigation, MedStar sent a letter to those whose data may have been exposed.

You are a “Settlement Class Member” if you were sent a letter by MedStar dated on or around December 19, 2022. Additionally, the Court also certified a Settlement Subclass that is included within the overall Settlement Class.

You are a “Settlement Subclass Member” if you were sent a letter by MedStar dated on or around December 19, 2022. The Settlement Subclass includes all persons whose medical information protected by HIPAA and other protected health information were potentially compromised as a result of the cyberattack that MedStar discovered in or about October 2022. The Settlement Subclass is included within the overall Settlement Class.


Your Legal Rights and Options in This Lawsuit
Submit a Claim Form

You must submit a valid Claim Form to get money from this settlement.

Claim Forms must be submitted online by February 23, 2024, or, if mailed, postmarked no later than February 23, 2024.

Object to the Settlement

Tell the Court why you do not like the Settlement Agreement. You will still be bound by the settlement if the Court approves it. You may still file a Claim Form and/or receive credit monitoring services.

Objections must be postmarked no later than January 24, 2024.

Exclude Yourself from the Settlement

Get no settlement benefits. Keep your right to file your own lawsuit against MedStar about the legal claims in this case.

Your request to exclude yourself must be postmarked no later than January 24, 2024.

Do Nothing

Get no settlement benefits. Be bound by the settlement.
